These Terms of Use govern access to and use of Safely ("Safely", "we"), operated by ART Tecnologia LTDA, CNPJ 44.574.159/0001-95. By creating an account or using the service, you ("customer", "you") agree to these terms. If you do not agree, do not use the service.
1. What Safely is
Safely is a traffic-filtering tool: based on criteria you configure (source, device, country, language, and technical signals), it decides, on each visit, which content is shown to each visitor. Safely is a neutral technology; the content, offers, and pages shown are defined and controlled solely by you.
2. Account and eligibility
You must have the legal capacity to contract and provide truthful information at sign-up. You are responsible for keeping your credentials confidential and for all activity carried out on your account. Notify us immediately of any unauthorized use.
3. Responsibility for use
You are solely responsible for the content you run, the offers you promote, and the way you use Safely. This includes, without limitation, responsibility for:
- Complying with applicable law in Brazil and in the jurisdictions where you operate;
- Respecting the policies and terms of the ad platforms and third parties you use;
- Obtaining the necessary authorizations and consents from the data subjects among your visitors;
- Ensuring that the content shown does not infringe third-party rights.
Safely does not review or endorse customer content and is not a party to the relationship between you, the ad platforms, and your visitors.
4. Prohibited uses
You agree not to use Safely for:
- Unlawful activities, fraud, scams, phishing, or malware distribution;
- Content that exploits minors, incites violence, or violates human rights;
- Infringing intellectual property, trademarks, or third-party rights;
- Compromising the security of the platform or of third-party systems;
- Any purpose prohibited by law.
We may suspend or terminate accounts that violate this section, without prior notice where necessary to contain harm or comply with the law.
5. Plans, billing, and cancellation
- The service is offered by subscription, with recurring billing according to the plan chosen;
- Usage limits (such as clicks per unique visitor) are counted and renewed monthly according to the plan;
- There is no lock-in: you may change plans or cancel at any time from the dashboard, effective at the end of the current cycle;
- Except as otherwise provided by law, amounts already paid for a period in use are non-refundable.
6. Disclaimer of warranties
Safely is provided "as is". We work to maintain high availability and effective filtering, but we do not guarantee that the service will be uninterrupted or error-free, nor that it will prevent blocks, bans, or penalties applied by third-party platforms. Those platforms' decisions are beyond our control.
7. Limitation of liability
To the maximum extent permitted by law, Safely is not liable for indirect damages, lost profits, lost revenue, bans of ad accounts, or loss of data arising from the use of or inability to use the service. Safely's total liability, in any case, is limited to the amount you paid in the 3 (three) months prior to the event that gave rise to the claim.
8. Suspension and termination
You may close your account at any time. We may suspend or terminate access in the event of a violation of these terms, non-payment, or legal requirement. After termination, data is handled in accordance with the Privacy Policy.
9. Intellectual property
The platform, the brand, the software, and Safely's documentation are owned by us. These terms do not transfer to you any right over our intellectual property, except the limited license to use the service while the subscription is active.
10. Changes to these terms
We may update these terms from time to time. Material changes will be communicated through the dashboard or by email. Continued use after the changes take effect constitutes agreement with the updated version.
11. Governing law and venue
These terms are governed by the laws of Brazil. The courts of the district of Goiânia, State of Goiás, Brazil, are elected as the venue to resolve any disputes arising from them, with waiver of any other, however privileged.
